Terms And Conditions For Courses, Certificates And Diplomas

1. Definitions and Interpretation

1.1 In these Terms, the following words have the meanings set out below:

  • "Academic Operations Centre" — the College department responsible for academic administration, reachable at [email protected].
  • "Al Razzaq Labs" — the practical, hands‑on cloud‑based laboratory environment comprising Part 1 (course‑embedded, assessed labs) and Part 2 (KYS‑based, internship preparation labs).
  • "Cohort"— the student group to which the Student belongs, determined by their enrolment date:
    • Legacy Cohort: Students enrolled on or before 31 July 2026.
    • New Lab‑Based Cohort: Students enrolled on or after 1 August 2026.
  • "Coursework" — all recorded lectures, live classes, lab assignments, and other learning materials provided as part of the diploma programme.
  • "Diploma" — an EduQual‑endorsed qualification at EduQual Levels 3, 4, 5, or 6.
  • "EduQual" — the awarding body that issues the diploma certificate and transcript.
  • "EduQual Learner Registration Fee" — the non‑refundable, non‑transferable fee paid to register the Student for a specific diploma title and level with EduQual.
  • "English Proficiency Exam" — either the IELTS UKVI (Academic) test or the Duolingo English Test (DET), as specified in these Terms.
  • "LMS" — the College's Learning Management System (Student Portal).
  • "MCQ" — Multiple Choice Question assessments.
  • "Programme Access Period" — the period during which the Student has access to course materials and assessments, commencing on their enrolment date.
  • "RPL" — Recognition of Prior Learning.
  • "KYS" — the Know Your Student form and process.
  • "Working Day" — any day other than Sunday or a public holiday in Pakistan.

1.2 Headings are for convenience only and do not affect interpretation.

1.3 References to policies are references to the College policies as amended from time to time, available on the Student Portal and website.


2. Enrolment and Contract Formation

2.1 The Student's enrolment constitutes an offer to study with the College. A binding contract is formed when the College accepts the enrolment and the Student pays the required course fee or first instalment.

2.2 The Student must provide accurate, complete, and truthful information during enrolment, including in the KYS form. The College reserves the right to reject any application or terminate enrolment if information is found to be false, misleading, or incomplete.

2.3 By enrolling, the Student confirms that they meet the minimum entry requirements for their chosen diploma programme as set out in Clause 3, or have been granted admission via the RPL process.

2.4 These Terms apply to all students irrespective of their Cohort, save where expressly stated otherwise.

2.5 The Student represents and warrants that they are at least 18 years of age, or if below 18, that their parent or legal guardian has consented to their enrolment and agrees to be bound by these Terms. The Student further warrants that they have the legal capacity to enter into a binding contract.

2.6 Student Account Security: The Student is responsible for maintaining the confidentiality of their Student Portal login credentials and for all activities that occur under their account. The Student must notify the College immediately of any unauthorised use of their account or any other breach of security. The College shall not be liable for any loss or damage arising from the Student's failure to comply with this obligation.


3. Admission Requirements

3.1 For the New Lab‑Based Cohort (enrolled on or after 1 August 2026), the following minimum entry requirements apply:

3.2 Legacy Cohort students are exempt from the admission prerequisites in 3.1 and may progress based on their existing enrolment status.

3.3 Applicants without formal qualifications may apply via RPL (see Clause 12). Professionals with relevant work experience may also apply by submitting an RPL form and justifying their experience in the KYS form.

3.4 The College reserves the right to refuse admission at its sole discretion.


4. Diploma Registration Fee

4.1 The EduQual Learner Registration Fee is mandatory for all students who wish to obtain an EduQual diploma certificate and transcript.

4.2 This fee must be paid within two (2) months of paying the course fee. Late payment results in penalties, and EduQual records the registration date as the date the fee was paid — not the course start date.

4.3 The fee is strictly non‑refundable and non‑transferable.

4.4 The Student cannot transfer the fee to a different diploma at the same level or upgrade to a higher level without paying a new registration fee.

4.5 Access to formal assessments (MCQs, and for Legacy Cohort, oral exams) is conditional on payment of the registration fee. Lab access requires only the course fee (Clause 5).


5. Course Access and Programme Duration

5.2 Monthly/quarterly/half‑yearly plans get content via a drip schedule. On full payment, remaining access: Level 5 → 15 months total; Level 6 → 18 months total.

5.3 New courses added during the access period are provided free; early access may be granted at the College's discretion.

5.4 Updated/replaced course materials are provided at no extra cost.

5.5 Technical/administrative delays granting access to new courses → 1 month free access as compensation.

5.6 Access is suspended upon expiry; renewal requires a new payment plan.

5.7 Students paying monthly after the initial 12 months get full access for the duration of payments.


6. Payment Terms and Fees

6.1 All fees payable in advance per the selected plan.

6.2 All payments (registration, course fees, certificates, transfers, assessments, etc.) are non‑refundable once processed, except as expressly stated in these Terms.

6.3 Student must review all details before payment; questions should go to support beforehand.

6.4 Fee changes don't affect already‑enrolled students on agreed plans.

6.5 Non‑payment → suspension of portal/materials/labs/assessments access; access period is not extended during suspension.


7. Assessments and Grading

7.2 Lab‑Based Assignments (Al Razzaq Labs Part 1)

  • 7.2.1 Part 1 labs are course‑embedded, assessed via AI‑augmented tool with real‑time feedback, human‑verified.
  • 7.2.2 Part 2 labs (KYS‑based) don't count toward the grade — used for internship prep and employability profiling.
  • 7.2.3 Labs divided into Basic, Intermediate, Advanced phases.
  • 7.2.4 Lab access = course fee paid; MCQ access additionally needs registration fee.
  • 7.2.5 Legacy Cohort: Part 1 available on course fee payment; Part 2 requires registration fee too. (New Cohort gets both on course fee.)
  • 7.2.6 Passing threshold: 40/100 per lab. Below 60 → reattempt allowed; 60+ → locked as complete.
  • 7.2.7 Failed lab → 1 resubmission within 30 days; second failure → repeat unit with full attendance.
  • 7.2.8 Incomplete labs by end of access period → renewal required.
  • 7.2.9 Lab version updates don't require redoing prior completed labs unless instructed.

7.3 MCQs

  • 7.3.1 Dynamically generated, randomised order; copy‑paste disabled.
  • 7.3.2 Unlimited attempts within 12 months from registration fee payment.
  • 7.3.3 Every bank must be passed; final score = average of passing attempts (40% New / 50% Legacy).
  • 7.3.4 Must be completed within Programme Access Period.

7.4 Oral Presentation & Viva Voce (Legacy Cohort Only)

  • 7.4.1 Applies only if not switched to new assessment.
  • 7.4.2 Topic assigned after 100% MCQs + 85% coursework completion.
  • 7.4.3 Minimum 6 weeks prep; complete within 12 months of receiving topic (no active LMS subscription required just for this).
  • 7.4.4 Must complete within 2 years of enrolment — after which, transitioned to new assessment structure.
  • 7.4.5 Missed 12‑month deadline → topic may be revoked (with prior reminders).
  • 7.4.6 Assessed via rubric: Content, Organisation, Presentation Skills, Visuals, Q&A Response.

7.5 English Proficiency Exam

  • 7.5.1 Mandatory for New Cohort & switched Legacy students.
  • 7.5.2 IELTS UKVI ≥6.5 or Duolingo 115–120.
  • 7.5.3 Test date within 2 years of diploma completion.
  • 7.5.4 Student handles registration/cost — College doesn't subsidize.
  • 7.5.5 Must use portal‑registered email for test registration.
  • 7.5.6 Fraudulent scores → disciplinary action, possible suspension/termination, Al Razzaq Program ban.
  • 7.5.7 Certificate withheld until this requirement is met.

  • 7.5.9 Visa Notice: IELTS UKVI accepted for UK/Australia/NZ/Canada visas; Duolingo generally not accepted for immigration. College not liable for visa refusals.
  • 7.5.10 Exemptions: 2+ years full‑time study in an English‑speaking country (MOI letter); prior degree entirely in English at non‑English institution; high scores on TOEFL/PTE/Cambridge C1. Not granted based on residency/nationality/enrolment alone.

7.7 Reassessment Rules

  • Labs: Repeat until correct; reassessment fees may apply.
  • MCQs: Unlimited attempts within access period; fees may apply.
  • English Exam: Resit until passing score; fees apply.
  • Legacy Oral: Fail oral only → £100 retake fee. Fail both oral + MCQs → full registration fee again. Missed 12‑month submission → possible £100 fee. One reschedule within 30 days.
  • General: Failure to complete everything within 2 years → £100 reassessment fee.

8. Assessment Access and Deadlines

  • 8.1 MCQ access valid 12 months from registration fee payment.
  • 8.2 Oral topic must be obtained within portal access period; 2 years to complete from enrolment.
  • 8.3 Missing 2‑year deadline → 10% grade reduction; late assessments marked as failed.
  • 8.4 Extension requests: submit ≥7 Working Days before deadline with evidence; approval at Senior Management's discretion.

9. Certification

9.1 Eligibility: Complete coursework + pass all assessments + settle fees + (where applicable) valid English test score.

9.3 Issuance & Batching: Processed in 6–12 month batch cycles by EduQual; EduQual may verify directly with Student. Certificates dispatched to Karachi campus. Expect 6–12 months from completion to physical delivery; expedited processing available for a fee.

9.4 Delivery: Free within Pakistan; courier fee applies outside Pakistan (communicated before shipment).

9.5 Name on Certificate: Must match KYS/ID documents exactly. Student responsible for accuracy. Post‑certification name changes incur additional fees.

9.6 Additional Documents:

  • Course Completion Certificate: issued if coursework done but registration fee unpaid (not a substitute for EduQual diploma).
  • Internship Letter: New Cohort — on full KYS–Al Razzaq–PitStop cycle completion.
  • Recommendation Letter: on request, valid 6 months.
  • Bonafide Certificate: for active students with ≥20% coursework, good standing.
  • Provisional Results: available post full completion; not formal certification.
  • Resume/CV: Legacy — 100% assessments + 70% coursework + Part 1 labs. New Cohort — KYS–Al Razzaq–PitStop milestones + ≥70% Merit labs + activated PitStop persona.

10. Cloud Lab Environment (Al Razzaq Labs)

  • 10.1 Accessible via browser GUI or SSH.
  • 10.2 Daily lab hours: L3 = 1hr, L4 = 2hrs, L5 = 2.5hrs, L6 = 3hrs (some specialisations get more).
  • 10.3 Al Bari AI Assistant monitors terminal activity in real time; logged in Activity Monitor.
  • 10.4 Automated offline evaluation; scores sync within 24–48 hours.
  • 10.5 Minimum 1 meaningful command required for evaluation, else score = 0.
  • 10.6 Manipulating/scripting/automating labs or copying solutions = malpractice (Clause 15).

11. Transfers, Progression, and Upgrades

  • 11.1 No same‑level diploma transfers — must register afresh with new fee.
  • 11.2 Upgrading to a higher level requires a new registration fee.
  • 11.3 Legacy Cohort may get additional lower‑level certificates via extra fees.
  • 11.4 Legacy students may switch to new lab‑based assessment via Transition Choice Form (no new registration fee); must then complete Part 1 labs, MCQs, English exam (oral exam waived).
  • 11.5 Transition Form deadline: 31 July 2026 — else default to original oral exam pathway (2‑year completion window).

12. Recognition of Prior Learning (RPL)

  • 12.1 Used for Admission (entry requirement) or Advanced Standing (credit/exemption).
  • 12.2 Not automatic — formal application with evidence required.
  • 12.3 Max 50% of total credits via RPL; core/capstone modules (incl. Al Razzaq Part 1) exempted only in exceptional cases.
  • 12.4 Evidence must be within last 5 years.
  • 12.5 Admission RPL — before/within first month of programme start; Advanced Standing RPL — within first month of enrolment.
  • 12.6 Fraudulent RPL documents → Plagiarism Policy violation, possible disqualification/expulsion.
  • 12.7 Admission RPL ≠ automatic Advanced Standing (separate application needed).
  • 12.8 Appeals available under Complaints and Appeals Policy.

13. Attendance and Engagement

  • 13.1 Punctual attendance expected; cameras on unless exempted.
  • 13.2 Sessions recorded for QA/attendance verification.
  • 13.3 Absences notified ≥24 hours in advance where possible.
  • 13.4 Watching recordings = acceptable substitute for certification purposes.
  • 13.5 New Cohort: min 80% attendance (live or recorded) required. Legacy Cohort: 100% of recordings must be watched.
  • 13.6 Poor engagement may delay/prevent certification; repeated unexcused absence handled under Misconduct Policy.

14. Academic Integrity and Conduct

14.1 Plagiarism and Academic Misconduct

  • 14.1.1 All submitted work must be original, properly cited.
  • 14.1.2 Detection via GPTZero, Quillbot, ZeroGPT, and AI‑content detection systems.
  • 14.1.3 Consequences:
    • 1st instance: Formal warning + resubmission (noted on record).
    • 2nd instance: Zero for the assignment + alternative assignment (max grade = pass).
    • 3rd instance: Expulsion.
  • 14.1.4 LLMs (ChatGPT, DeepSeek, Claude, Gemini) prohibited for writing oral presentation text; undisclosed AI/pre‑recorded responses = violation.

14.2 General Student Misconduct

  • 14.2.1 Includes: plagiarism, cheating, unauthorised aid, falsifying records, disruptive/disrespectful behaviour, harassment, IT misuse, unauthorised sharing of materials, policy/deadline non‑compliance.
  • 14.2.2 Minor misconduct — informal resolution; serious/persistent — formal investigation/hearing.
  • 14.2.3 Possible outcomes: No case to answer; written warning; supervised resubmission; suspension; expulsion.
  • 14.2.4 Serious breaches (fraud, harassment, criminal behaviour) may be reported to authorities.

15. Malpractice and Maladministration

  • 15.1 Malpractice = deliberate acts compromising integrity/fairness. Maladministration = administrative failure/poor management causing non‑compliance.
  • 15.2 Report suspected cases to [email protected].
  • 15.3 Sanctions: Rejection of evidence; suspension/termination; certificate cancellation; re‑enrolment bar; invalidation of prior certificates.
  • 15.4 Full procedures in Malpractice & Maladministration Policy / Plagiarism Policy.

16. Special Considerations

  • 16.1 For extenuating circumstances (illness, bereavement, financial hardship, work commitments).
  • 16.2 Formal application + evidence to [email protected], ASAP.
  • 16.3 Decision within 10 Working Days; approved suspensions ≤12 months (extendable).
  • 16.4 Access period paused during approved suspension; fees held and applied on re‑registration.
  • 16.5 Short‑term deadline extensions follow Clause 8.4 process.

17. Complaints and Appeals

17.1 Complaints

  1. Informal: 24/7 Live Support → formal complaint to [email protected] (response in 3–7 Working Days).
  2. Formal Review: Escalate to Academics Department Lead (ack. in 2 days, resolution in 7 days).
  3. External Review: Escalate to higher management, awarding bodies, or regulators.

17.2 Appeals

  2. Formal Appeal: Submit within 14 Working Days of informal response/decision (ack. within 3 days).
  3. Final Decision: Independent panel decides within 15 Working Days of acknowledgment.

18. Data Protection and Record Keeping

  • 18.1 Certification data retained indefinitely per regulatory standards.
  • 18.2 Records: Registration/KYS docs, progress/assessment records, certificate claims, transcripts, AI grading logs & feedback (3‑year retention).
  • 18.3 Securely stored; access restricted to authorised personnel.
  • 18.4 Student may access/correct/delete personal data via [email protected].
  • 18.5 Governed further by the College's Privacy Policy (incorporated by reference).

19. Intellectual Property

  • 19.1 All course materials remain IP of Al Nafi E‑Learning Private Limited / subsidiaries.
  • 19.2 No reproduction/distribution/sharing without written permission — violation = misconduct.
  • 19.3 User‑generated content (forum posts, comments) — Student grants College a non‑exclusive, royalty‑free, worldwide licence for educational service purposes; Student warrants rights to their own content.

20. Accessibility and Reasonable Adjustments

  • 20.1 Adjustments available for documented disabilities (extra time, alternative formats, modified labs, assistive tech).
  • 20.2 Request ≥4 weeks before assessment date, with documentation, to [email protected].

21. Student Equipment and Connectivity

  • 21.1 Student responsible for own equipment/software/internet.
  • 21.2 College not liable for access issues from Student's equipment/connection.

22. Technology and Platform

  • 22.1 Reasonable efforts to maintain availability; no uninterrupted access guarantee.
  • 22.2 Contingency plans for technical failures during assessments — no student disadvantaged.
  • 22.3 Report technical issues promptly via live chat/support email.

23. Third‑Party Test Providers

  • 23.1 College doesn't operate/control Duolingo, IELTS, etc. — no responsibility for their services.
  • 23.2 Disputes regarding test registration/results/bans are strictly between Student and provider.

24. Indemnification

Student indemnifies the College against claims arising from: breach of Terms; violation of law; IP infringement; fraud/negligence/wilful misconduct.


25. Limitation of Liability

  • 25.1 Liability capped at total fees paid in the preceding 12 months.
  • 25.2 No liability for indirect/consequential losses (income, opportunity, career prospects).
  • 25.3 Nothing excludes liability for death/personal injury from negligence, fraud, or non‑excludable liability.
  • 25.4 No liability for: visa/immigration decisions; university admissions; employment outcomes; reliance on third‑party info the Student should verify independently.

26. Force Majeure

  • 26.1 No liability for delays from events beyond reasonable control (acts of God, pandemics, war, civil unrest, government action, outages, third‑party failures).
  • 26.2 Reasonable efforts to minimise disruption; no obligation to refund/extend unless legally required.

27. Withdrawal and Cancellation by Student

  • 27.1 Withdraw anytime via written notice to Academic Operations Centre.
  • 27.2 Outstanding fees remain due; no refunds.
  • 27.3 Access terminated within a reasonable time after withdrawal notice.

28. Amendments and Variations

  • 28.1 College may update Terms/policies anytime.
  • 28.2 Material changes communicated via email/portal; continued enrolment = acceptance.
  • 28.3 Most recently published policy prevails in case of conflict.

29. Governing Law and Jurisdiction

Governed by the laws of Pakistan; Pakistani courts have exclusive jurisdiction.


30. General Provisions

  • 30.1 Severability — invalid provisions don't affect the rest.
  • 30.2 Entire Agreement — supersedes prior agreements.
  • 30.3 Waiver — no waiver by delay/failure to enforce.
  • 30.4 Third Party Rights — none, except parties to these Terms.
  • 30.5 Notices — via registered email or [email protected].
  • 30.6 Language — English version prevails over translations.
  • 30.7 Assignment — Student cannot assign rights without consent; College may assign freely.
  • 30.8 Compliance with Laws — Student responsible for lawful use of services.
  • 30.9 Survival — Clauses 18, 19, 24, 25, 28, 29, 30 (and others by nature) survive termination.
  • 30.10 No Employment/Partnership — Student is a learner only, not employee/agent/contractor.
